  • Today, the Center for Gender & Refugee Studies at UC Hastings and Human Rights Watch called on the government to uphold refugee protections for survivors of domestic violence. They also released a video in which Ms. A.B. shares her story of abuse in El Salvador, the impossibility of finding protection in her home country, and her quest to find safety in the United States.

    “Ms. A.B. suffered brutal physical, sexual, and emotional abuse, and every time she sought protection from the Salvadoran authorities, the police would not protect her,” said Professor Karen Musalo, one of the woman’s attorneys and director of the Center for Gender and Refugee Studies. “In denying her asylum, the former attorney general not only overturned clearly established case law recognizing the right to asylum for survivors of domestic violence, but also repudiated the well-accepted principle that women’s rights are human rights.”

    ...Sessions’s ruling “tries to bully decision-makers to deny these cases,” said Karen Musalo, a professor at UC Hastings and director of the Center for Gender and Refugee Studies. “The attorney general with this decision doesn’t rip out stem and root the viability of these cases. But he’s trying to signal that these cases are no longer viable, and some asylum officers doing credible fear interviews, and some judges reviewing cases — they are going to take the path of least resistance and dismiss.”
